1. Definitions

1.1 New condition: a new, unused, undamaged (not torn, scratched, cut, dyed or adjusted) item.

1.2 Unused: an item that has only been unpacked and worn once to examine its look and fit.

1.3 Noticeable mistake (from the customers’ point of view): a mistake in pricing or offer that financially and logistically cannot be performed by Afritique.

1.4 Unpurposeful manner: using or wearing the item in ways or manners other than purposed by the manufacturer.

2. In general

2.1 These terms and conditions are applicable to all of Afritique’s’ offers. The terms and conditions is available to the public on the website www.afritiqueshop.com.

2.2 Identity of the company.

www.afritiqueshop.com is a site operated by Afritique Incorporated. We are registered in The Netherlands under company number 69546959 and with our registered office at Katwijkstraat 28, 2586 VP, The Hague. Our e-mail address is [email protected].

2.3 By placing an order the customer acknowledges to have read and accepted the terms and conditions. Afritique reserves the right to change the terms and conditions

2.4 Unless otherwise agreed upon in writing, the terms and conditions of third parties will not be recognised.

2.5 Afritique guarantees that the delivered item(s) is in correspondence with the agreement and meets the specifications mentioned in the offer.

3. Delivery

3.1 All orders are subject to availability.

3.1 All orders will be carried out within five (5) working days.

If this is not possible, because the item is not in stock, the item is no longer available, the order cannot be carried out in whole or in part, or it is delayed for any reason, the customer will be notified within five (5) working days after placing the order and has the right to cancel the order without any costs or notice of default.

3.3 The address given by the customer to Afritique will count as place of delivery.

3.4 Afritique will have met the obligation to deliver, in absence of proof of the contrary, when Afritique has offered the ordered item(s) once to the customer. When delivered to a home address the carriers report, withholding refusal of acceptance, will be proof of offering the item(s).

3.5 All deadlines, mentioned on our website, are an indication. No rights can be derived from the mentioned deadlines.

3.6 Customs, Duties and Taxes

Afritique is not responsible for any customs and taxes applied to the customers’ order. All fees imposed during or after shipping is the responsibility of the customer (tariffs, taxes, etc.).

3.7 Damages

Afritique is not liable for any items damaged or lost during shipping. If the customer has received an order damaged, please notify Afritique immediately by sending an e-mail to [email protected]. Save all packaging materials and damaged goods in order for Afritique to file a claim at the respective post order company and to refund the costumer.

4. Pricing

4.1 Prices will not be increased during the term of the offer, unless legal measures make this necessary.

4.2 The website may contain typographical errors or other errors or inaccuracies. Afritique therefore reserves the rights to correct any errors or inaccuracies and change or update information at any time without a prior notice. Afritique cannot be held accountable for the consequences of these typographical errors, other errors or inaccuracies.

4.3 Prices are shown in Euro’s. Where applicable, prices are including VAT, at the rate appropriate in the Netherlands. Shipping costs will be charged in additions; additional charges are clearly displayed where applicable and are included in the total costs.

5. Right of Withdrawal

5.1 The customer has the right to cancel the purchase of an item without having to give a reason at any time within the “cooling off period” of thirty (30) calendar days beginning on the day after receipt of ordered item(s). To be eligible for a return, the item(s) must be unused and in the same condition that it was received. More information can be found on our shipment and return page.

5.2 When a customer is in possession of the items that customer is under the duty to retain them and take reasonable care of them (e.g. store them in the delivery box, inside your house and away from your pets). You must send the items back to our contact within thirty (30) calendar days once the customer cancelled the contract. The item(s) must be in the original packaging provided with the original packing slip.

5.3 We reserve the right to hold on to your payment, not exceeding our direct costs of recovering the items, if a customer does not return the item(s).

5.4 Once Afritique has received the item(s), any payment made will be refunded in the same way the payment was made. When we receive the item(s), we will inspect and notify the customer that we have received the returned item(s). We will immediately notify the customer on the status of the refund after inspecting the item(s).

6. Customer Privacy

6.1 If a customer places an order with Afritique, your personal information will be kept on Afritique’s’ customer database. Afritique will not share personal information with third parties. More information can be found in our Privacy Policy.

6.2 Afritique respects the privacy of the users of the website and will handle his/her personal information in confidentiality.

6.3 Afritique uses a mailing list for our newsletters. Every mailing includes instructions to unsubscribing.

7. Guarantee

7.1 The customer is obliged to check the item(s) immediately after they have been delivered. If the delivered item(s) appear(s) to be incorrect, faulty or incomplete, the customer must report these defects to Afritique by e-mailing [email protected] immediately, before sending back the items. Returns must be sent back in original packaging (including accessories and related documentation) and be in new condition. Usage after noticing any defects, damage after noticing any defects, encumbrance and/or resale after noticing any defects, will make the right to return the item(s) void.

7.2 If Afritique approves the notice of defect of the customer, Afritique will either replace the item(s) free of charge or agree upon a compensation with the customer. The responsibility of Afritique and the height of compensation is limited to the amount invoiced or (at Afritique’s’ choice) the maximum amount covered by Afritique’s’ liability insurance for that particular situation. Afritique is not responsible for any other type of damage including but not limited to water damages, fire damages, chemical damages, and damages occurred after using the item in an unpurposeful manner.

7.3 This guarantee does not apply in the following cases: A) the customer is in default against Afritique; B) the customer has repaired and/or adapted or has a third party repair and/or adapt the delivered item(s): C) the delivered item(s) have been exposed to abnormal circumstances including but not limited to water, sources of heat and chemicals, or have been treated in a reckless way or have been treated differently than advised in the instructions on the package by the user of the item(s).

8. Special offers

8.1 Afritique’s’ special offers do not automatically apply to repeat orders.

8.2 Afritique cannot be obliged to offer a special offer, if a customer should have been able to understand that the special offer, or part of the offer, contained a noticeable mistake or typographical error.

9. Agreement

9.1 An agreement between Afritique and a customer is realised after Afritique has received the payment and can only be unbound if the item(s) is/are no longer available.

9.2 Afritique reserves the right to refuse an order in cases where in the delivery costs exceed the amount of 15EUR, or when the shipping address is located in a remote area where delivery by a post order company is impossible.

10. Images and specifications

10.1 All images: photos; drawings etc.: for example, details about weights, measurements, colours, images or labels, etc, on the Afritique’s’ website are an indication and cannot be a reason to claim compensation or cancel the agreement.

11. Force majeure

11.1 Afritique cannot be held accountable for delays or cancellations of order due to circumstances beyond Afritique’s’ control.

11.2 The circumstances pertaining to force majeure are all unusual causes and circumstances, which should not belong to Afritique’s’ risks and are all circumstances beyond Afritique’s’ control. These include but are not limited to delays or non-fulfilment of obligations by Afritique’s’ suppliers, problems with the internet, electricity failures, problems with e-mail traffic and failures or changes in technology supplied by third parties, problems in transport, strikes, government regulations, delays in supply, negligence of Afritique’s’ suppliers and/or manufactures including other assistants, illness of employees and shortcomings in means of transport.

11.3 Afritique reserves the right to postpone its obligations and also has the right to cancel the agreement partially or entirely or modify the content of the agreement to make it possible to execute in case of a force majeure. In no case will Afritique be obliged to pay a fine or compensation.

11.4 In cases Afritique cannot meet its obligations, or can only partially meet its obligations due to force majeure, Afritique must invoice the available part of the order separately and the customer is obliged to pay the invoice as if it were a separate contract. This does not apply if the available part of the order does not have any independent value.

12. Responsibility

12.1 Afritique cannot be held accountable for damage to people or objects due to incorrect use of the item(s).

13. Governing law and jurisdiction

13.1 These Terms and Conditions are governed by Dutch law.

13.2 Any contract for the purchase of all items from this site and any dispute or claim arising out of or in connection with any such contract will be governed by Dutch law.

13.3 Afritique and customer hereby both agree that the courts of The Netherlands, within the municipality wherein Afritique is registered, will have non-exclusive jurisdiction
